Terms & ConditionsTerms and Conditions for use of website and supply of goods 1. DEFINITIONS 1.1 The Company (H 2 O Life Limited). 2.1 These conditions apply to all transactions on this website. No other terms or conditions shall be included or implied unless previously agreed upon in writing or electronically by the Company and in the event of any conflict or inconsistency between these Conditions and the terms of the Customer's order, these Conditions shall prevail. Please read them carefully before using the website. They do not affect your statutory rights. 2.2 By using this website you confirm you have read and understood and agree to be bound by these Conditions. 2.3 We may change these Conditions from time-to-time. Any changes will be effective from the date they are posted on the site (see last update above). Notification that the Conditions have changed will be posted on the home page of the website. 2.4 When using our website, you are communicating with us electronically. We communicate with you by email or posting notices on the website. For contractual purposes, you agree that electronic communications, agreements and notices satisfy any legal requirement that such communications be in writing. 2.5 We reserve the right to change, suspend or withdraw any part of our website. 2.6 All rights in the designs and information on our website are owned by us. You may only reproduce or print the material for the purpose of ordering goods from us. Any other use or copying of this site is prohibited without express written consent. 3.1 You will complete an on-line order form with the details of your purchase, delivery address, email address and telephone number and method of payment. 3.2. You will be able to check and correct any input errors in your order up until you click the SUBMIT ORDER icon. 3.3 Your order represents an offer to us to purchase a product and shall be accepted entirely at the discretion of the Company. 3.4 Orders placed on-line will be acknowledged automatically by e-mail. The e-mail acknowledges receipt of the order but does not confirm acceptance of the order or availability of goods. 3.5 No contract will exist between you and H 2 O Life Limited until the goods are despatched. Acceptance will be deemed complete on despatch and confirmation of despatch will be sent to you by e-mail. You will be provided with information in order that you can track your goods should you need to. Ownership of the goods will pass to you on despatch of the goods. 3.6 Products are subject to availability. If something becomes unavailable after an order is submitted, we will advise you and may, if possible, offer an alternative 4.1 The Price of the goods shall be the price listed on the website at the date of despatch of the goods. Prices are in UK pounds and include VAT payable. Delivery charges will be added and form part of the Price (see Schedule of Delivery Charges). 4.2 All prices shown on the Company's price list or any prices quoted by the Company are subject to variation without prior notice in the event of any increase in the cost to the Company, which is due to any factor beyond its reasonable control. 4.3 We make every effort to ensure accuracy of the prices on our website. In the unlikely event that a product is mis-priced, the correct price will be verified prior to despatch. If the correct price is lower than that stated, we will charge the lower price. If the correct price is higher, we will contact you for instructions and you will have the option to cancel your order and receive a refund. 5.1 All goods shall be paid for in full by credit or debit card at the time the order is submitted. You will be advised you are entering a secure site at the time your payment details are requested to minimise the risk of your card details being read by an unauthorized individual over the internet. Payment can be made by Visa, Mastercard, Switch, Solo or Delta Debit card. Refunds will only be made by crediting your card account electronically. 5.2 We will advise you if your payment cannot be accepted for any reason and invite you to check your credit card details or enter the details of another card. 6.1 Delivery will be within 3-days of receipt of the confirmation email ( UK only). 6.2 Any date or time given by the Company to the Customer for the delivery of the goods is an estimate only. While the Company will always endeavour to meet dates or times given or specified by either party, no such dates or times shall be binding on the Company or form part of the contract. All deliveries are subject to stock availability and we will not be liable for any loss caused to you by late delivery, or due to carrier action beyond our control. We will attempt to deliver your order to the delivery address stated on your order form. If the address on the form is incorrect and prevents delivery of your goods or you fail or refuse to take goods tendered for delivery or delivery is prevented for any other reason not being the fault of the Company, we shall deduct the carriage costs from any refund due. If goods are re-delivered to a revised address, a charge for all carriage costs incurred will be added to the cost of the goods and be included in the Price. You have the statutory right to cancel your order at any time up to the end of the seventh working day following the day after the day on which you receive the products. If you wish to cancel your order please contact us by e-mail at info@H2Olife.co.uk . Where goods have been despatched they must be returned in perfect condition unused and in the original packaging. We will issue you with a Returns Authorisation Number and instructions on how to return the goods to us. Upon receipt of the goods in perfect condition, H 2 O Life will credit your card account with the purchase price. H2O Life will not be responsible for any refund of postage or carriage costs. We will take great care to ensure you receive your goods in perfect condition and good working order. However, if your goods are damaged or faulty on receipt please e-mail us within 24 hours at info@H2Olife.co.uk describing the fault. We will then issue you with a Returns Authorisation Number and instructions on how to return the goods to us. You will be asked to return the goods using an instructed courier and obtain proof of despatch. You retain responsibility for the goods until received by us. Please check the product and instructions carefully before returning faulty goods as we will not refund carriage charges on goods found not faulty and will return the goods at your cost if we do not find them faulty. This website and its contents are provided to you on an “as is” and “as available” basis. We do not make and expressly disclaim to the fullest extent permitted by law any and all representations or warranties of any kind with respect to this website and its contents including without limitation its completeness, accuracy, fitness or suitability for any purpose or freedom from viruses. We, our directors, employees and other agents shall not be liable for damages of any kind including with limitation, direct, indirect, special or consequential damages, loss of income or profits, loss of or corruption of data, loss of or damage to property or claims of third parties, arising out of or in connection with your use of this website. Please read the instruction manual carefully before installing/using the goods. The Company will not be responsible for any damage to goods if this is caused by use other than in accordance with the manufacturer's instructions. Errors and omissions made when ordering shall be your responsibility and care should be taken when entering information onto the web site. Liability for the quality, defect or failure of the goods will be limited to the fullest extent statutorily possible to the value of the goods. Your statutory rights will not be affected. These conditions are governed and construed in accordance with English Law. You agree with us to submit to the jurisdiction of the English Courts. 11.1 If any clause or sub-clause of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other clauses or sub-clauses and the remainder of the provisions in question shall not be affected thereby. 11.2 No waiver by the Company of any breach of these Conditions shall constitute a waiver of any other breach and no failure to exercise fully or partially any remedy shall constitute a waiver of the right to exercise that remedy or any other remedy in the future. 12.1 The Company shall not be under any liability in respect of specifications, illustrations or other matter in relation to goods contained in any material such as brochures, price lists or trade publications, descriptive or advertising matter or delivery notes other than in respect of specifications expressly set out in the Company's acknowledgement of order. At H 2 O Life, we respect your privacy and will only use the personal information that you supply us when using our website. When you place an order we collect your name, e-mail address, mailing address, phone number and credit card information. We may record which products you are interested in and which products you purchase. This enables us to process your orders efficiently and to improve the products and service that we are offering. We may use this information to inform you of any new products or special offers that we think may be of interest to you or about changes to our website. Please e-mail us if you do not want us to send you this information. We will not sell, trade or rent your personal information to other companies nor will we share any of the information we collect about you to third parties except as necessary to complete your order.
